These Terms of Service (Terms) govern your access to and use of the independent MiniMax H3 service available at minimaxh3.studio, including its website, AI generation tools, accounts, credits, subscriptions, and public API (collectively, the Service). By using the Service, you agree to these Terms and the policies referenced below. If you do not agree, do not use the Service.
You must be at least 18 years old and legally able to enter into a binding agreement to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes the organization.
MiniMax H3 is an independent service that connects to AI and infrastructure providers. It is not the official MiniMax website and is not endorsed by MiniMax unless expressly stated. MiniMax and related model or product names are trademarks of their respective owners.
You must provide accurate information, keep your credentials and API keys confidential, and promptly notify us of suspected unauthorized use. You are responsible for activity performed through your account or keys unless applicable law provides otherwise. We may require verification, limit account creation, or take reasonable steps to prevent fraud and abuse.
The Service lets you submit prompts and reference materials to generate, manage, and export AI-created media. AI outputs are probabilistic and may be inaccurate, incomplete, offensive, unexpected, or similar to content produced for others. We do not guarantee that an output will meet your expectations, be unique, be error-free, or be suitable for a particular purpose.
You are responsible for reviewing outputs before using or publishing them and for complying with applicable law, third-party rights, disclosure duties, and professional standards. Do not rely on the Service for medical, legal, financial, safety-critical, or other high-impact decisions.
You retain any rights you have in prompts, uploads, reference materials, and outputs (User Content). You grant us and our service providers a worldwide, non-exclusive, limited license to host, copy, transmit, modify, and process User Content only as needed to operate, secure, support, and improve the Service and to comply with law.
You represent that you have all rights and permissions needed to submit User Content and authorize this processing. You may not upload confidential or personal information unless you are authorized to do so and have provided any notices or obtained any consents required by law.
Your ability to use an output, including commercially, may depend on your plan, applicable law, third-party rights, and the terms or restrictions of upstream providers. These Terms do not transfer to you any rights in third-party trademarks, copyrighted works, likenesses, or other protected material that may appear in an output.
You must follow our Acceptable Use Policy. You may not use the Service for unlawful, harmful, exploitative, deceptive, infringing, or abusive activity; to violate another person's privacy or publicity rights; to impersonate others deceptively; to distribute malware; or to bypass safety, security, rate, account, or billing controls.
Purchases, duplicate charges, failed generations, and refund requests are governed by our Refund Policy.
The public API is part of the Service. Keep API keys secret and use them only from trusted server-side environments. You are responsible for requests made with your keys. API requests may be subject to documented versions, credit charges, quotas, rate limits, safety checks, and technical restrictions.
We may reject, throttle, or suspend malformed, unsafe, abusive, unauthorized, or unusually burdensome requests. We may change or discontinue an API version with reasonable notice when practical, except where an urgent security, legal, or reliability issue requires faster action.
We use third-party providers to support AI generation, hosting, storage, authentication, analytics, communications, and payments. Their systems and terms may affect feature availability and processing. Our handling of personal information is described in our Privacy Policy, and our use of cookies is described in our Cookie Policy.
The Service's original software, interface, design, documentation, branding, and content are owned by or licensed to the Service operator and are protected by applicable law. Except for the limited right to use the Service under these Terms, no rights are granted to you. You may not copy, reverse engineer, resell, sublicense, or distribute protected parts of the Service except where applicable law expressly permits it.
If you voluntarily provide feedback, you grant us a worldwide, perpetual, irrevocable, royalty-free right to use it without restriction or compensation, provided we do not identify you publicly without permission.
You may stop using the Service at any time. We may restrict, suspend, or terminate access when reasonably necessary to address a Terms or policy violation, fraud, security risk, legal requirement, nonpayment, harm to the Service or others, or discontinuation of the Service.
On termination, your right to use the Service ends. Provisions that by their nature should survive—including provisions about payments, intellectual property, disclaimers, liability, disputes, and indemnity—will survive. Subject to our Privacy Policy and applicable law, account content may be deleted after termination.
To the fullest extent permitted by law, the Service is provided “as is” and “as available.” We disclaim all implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant uninterrupted availability, permanent storage, error-free operation, or any particular result from AI generation.
Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.
To the fullest extent permitted by law, the Service operator and its affiliates, officers, employees, contractors, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunity arising from the Service.
These exclusions apply only to the extent permitted by law. Nothing in these Terms limits liability for fraud, willful misconduct, death or personal injury caused by negligence, or any other liability that cannot lawfully be excluded or limited.
To the extent permitted by law, you will defend, indemnify, and hold harmless the Service operator and its affiliates, officers, employees, contractors, and providers from third-party claims arising from your User Content, your unlawful or unauthorized use of the Service, or your material breach of these Terms. This section does not apply to consumers where prohibited by law.
Applicable law, mandatory consumer protections, and courts with jurisdiction over you and the Service operator govern disputes relating to these Terms. Nothing in these Terms deprives you of rights or a forum that cannot be waived under the law that applies to you. We do not impose binding arbitration through these Terms.
Before filing a claim, please contact us and provide a brief description of the issue so the parties can try to resolve it informally. This does not prevent either party from seeking urgent relief or using a regulatory or small-claims process where available.
We may update these Terms to reflect changes to the Service, law, security requirements, or business practices. We will post the revised Terms and update the date above. If a change materially reduces your rights, we will provide additional notice when required. Changes apply prospectively from their effective date.
